AUTOCOMPOSIÇÃO DE CONFLITOS: DA CULTURA DE LITIGÂNCIA À SOLUÇÃO CONSENSUAL.

A RESPONSABILIDADE CIVIL PELO ABUSO DO DIREITO À LIBERDADE DE EXPRESSÃO EM CONFLITO COM OS DIREITOS DA PERSONALIDADE: UMA ANÁLISE DO CASO DAS BIOGRAFIAS NÃO AUTORIZADAS.

RESUMO Este artigo apresenta e discute acontecimentos que emergiram no decorrer de uma pesquisa-intervenção com jovens, visando problematizar as contribuições para a formação ética, estética e política tanto dos pesquisadores como dos participantes. Oficinas estéticas mediadas por linguagens artístico-visuais consistiram no modus operandi da pesquisa-intervenção, sendo os acontecimentos relativos à oficina de graffiti o foco das análises aqui apresentadas. Participaram dessa oficina entre 20 a 25 jovens matriculados em uma escola pública municipal de Florianópolis/SC, com idades entre 13 e 16 (...) anos. As atividades foram coordenadas por bolsistas de IC e extensão, graduandos de psicologia, e um bolsista AT, grafiteiro. Os registros das atividades foram feitos via filmagens, fotografia e registros em diário de campo. As análises foram realizadas a partir de uma perspectiva dialógica, com foco na responsividade que conota as ações e pauta a condição alteritária da existência.ABSTRACT This paper presents and discusses events that emerged in the course of research involving an intervention conducted with youngsters. The objective was to discuss contributions to ethical, aesthetic and political formation of both the researchers and participants. Aesthetic workshops mediated by artistic-visual languages consisted of the modus operandi of the intervention research, and the events related to a graffiti workshop were the focus of this analysis. From 20 to 25 youngsters, aged between 13 to 16 years old and enrolled in a city public school in Florianópolis, SC, Brazil participated. The activities were coordinated by undergraduate research assistants, senior psychology students, and one graffiti artist who received a Technical Support scholarship. The activities were filmed, photographed and recorded in a field diary. The analyses were conducted from a dialogic perspective focusing on responsiveness that connotes the actions and grounds the otherness nature of existence. (shrink)

Neste artigo pretendemos compreender se, e de que forma, o cinema pode servir a uma cosmopoética do pensamento decolonial. Para tanto, nos apoiaremos em alguns conceitos dos estudos decoloniais, que buscam atualizar a tradição crítica do pensamento latino-americano a partir da problematização do pensamento hegemônico, oferecendo novas releituras histórias e novas possibilidades de produção dos saberes. A perspectiva decolonial opera fornecendo novos horizontes para o pensamento, promovendo uma ecologia dos modos de saber e conhecimento não reconhecidos pelas epistemologias dominantes. Assim, (...) buscamos entender a potência cosmopoética do cinema e como ele pode contribuir, dentro dos espaços de educação, como alternativa epistemológica para o pensamento decolonial. (shrink)

Pablo Gilabert and Holly Lawford-Smith have, both in collaboration and individually, provided a compelling account of feasibility, which states that feasibility is both ‘binary’ and ‘scalar’, and both ‘synchronic’ and ‘diachronic’. This two-dimensional analysis, however, has been the subject of four major criticisms: it has been argued that it rests upon a false distinction between ‘hard’ and ‘soft’ constraints, that it ignores the importance of intentional action, and that diachronic feasibility is incoherent and insensitive to the existence of epistemic limitations. (...) In this paper, I will argue that such objections do not undermine the persuasiveness of Gilabert and Lawford-Smith’s analysis. Nevertheless, I will contend that the latter is susceptible to two other challenges. First, it mistakenly appeals to morality, and, second, it lacks an analysis of ability. I will maintain, however, that such criticisms can be addressed and that a revised version of the account should be adopted. (shrink)

This study focuses on retraction notices from two major Latin American/Caribbean indexing databases: SciELO and LILACS. SciELO includes open scientific journals published mostly in Latin America/the Caribbean, from which 10 % are also indexed by Thomson Reuters Web of Knowledge Journal of Citation Reports. LILACS has a similar geographical coverage and includes dissertations and conference/symposia proceedings, but it is limited to publications in the health sciences. A search for retraction notices was performed in these two databases using the keywords “retracted”, (...) “retraction” “withdrawal”, “withdrawn”, “removed” and “redress”. Documents were manually checked to identify those that actually referred to retractions, which were then analyzed and categorized according to the reasons alleged in the notices. Dates of publication/retraction and time to retraction were also recorded. Searching procedures were performed between June and December 2014. Thirty-one retraction notices were identified, fifteen of which were in JCR-indexed journals. “Plagiarism” was alleged in six retractions of this group. Among the non-JCR journals, retraction reasons were alleged in fourteen cases, twelve of which were attributed to “plagiarism”. The proportion of retracted articles for the SciELO database was approximately 0.005 %. The reasons alleged in retraction notices may be used as signposts to inform discussions in Latin America on plagiarism and research integrity. At the international level, these results suggest that the correction of the literature is becoming global and is not limited to mainstream international publications. (shrink)

Healthcare professionals often face ethical conflicts and challenges related to decision-making that have necessitated consideration of the use of conscientious objection (CO). No current guidelines exist within Spain’s healthcare system regarding acceptable rationales for CO, the appropriate application of CO, or practical means to support healthcare professionals who wish to become conscientious objectors. As such, a procedural framework is needed that not only assures the appropriate use of CO by healthcare professionals but also demonstrates its ethical validity, legislative compliance through (...) protection of moral freedoms and patients’ rights to receive health care. Our proposal consists of prerequisites of eligibility for CO (individual reference, specific clinical context, ethical justification, assurance of non-discrimination, professional consistency, attitude of mutual respect, assurance of patient rights and safety) and a procedural process (notification and preparation, documentation and confidentiality, evaluation of prerequisites, non-abandonment, transparency, allowance for unforeseen objection, compensatory responsibilities, access to guidance and/or consultative advice, and organizational guarantee of professional substitution). We illustrate the real-world utility of the proposed framework through a case discussion in which our guidelines are applied. (shrink)

O ficcionalismo, geralmente classificado como um tipo de nominalismo, apresenta como perspectiva precípua a tese de que os entes matemáticos são ficções. Para o ficcionalista, o discurso matemático é desprovido de conteúdo. Hartry Field, que é o principal defensor dessa concepção ontológica da matemática, contesta, em Science Without Numbers, a utilização de entes matemáticos na redação de teorias da física, alegando que a defesa mais plausível do realismo ontológico matemático é o argumento da indispensabilidade de Quine-Putnam. O ficcionalismo defendido por (...) Field nos permite, de acordo com Shapiro, classificá-lo no grupo filosofia-primeiro, ou seja, entre os filósofos que defendem que a filosofia deve ser responsável por legislar a respeito da prática matemática. Dessa forma, podemos considerar Field um revisionista epistemológico. Como se sabe, a dependência da ciência moderna em relação ao discurso matemático coloca a tese ficcionalista em xeque. Ainda assim, se partirmos dos pressupostos filosóficos da vertente formalista da filosofia da matemática, que concebe a matemática como constituída de um conjunto de regras sem significado que podem ser manipuladas de maneira puramente sintática, poderemos traçar importantes analogias entre matemática e ficção, tal como também entre metamatemática e metaficção. Para um formalista simpático à tese ficcionalista, o estatuto ontológico da matemática é semelhante ao das regras de um jogo de xadrez. (shrink)

Owing to various reasons, Stalinism still represents, according to this essay, a fertile intellectual topic. Therefore, my aim here is to offer a reading of Pavel Campeanu’s works on Stalinism – a relatively unknown Romanian Marxist – through the social history of the Soviet Union in general and of Stalinism in particular advanced by Moshe Lewin. The argumentation advances by taking into account the overall historical frame of the debate (Eastern and Western Marxism during the Cold War) and by stressing (...) some key issues like primitive accumulation, legitimacy, a certain overstretching of the concept of Stalinism and, finally, the issue of totalitarianism. The stake of the essay resides in claiming that Campeanu’s analyses of Stalinism, original and convincing as they are, may favor, in the above-mentioned issues, and regardless the author’s intentions, interpretations belonging to or deriving from the totalitarian school of Cold War and Soviet Studies. Este artigo intenciona compreender a dimensão discursiva das pinturas por meio da análise do discurso ancorada em Michel Foucault. Recorta-se a figura do espelho em pinturas canônicas com vistas a observar seu funcionamento discursivo enquanto elemento do enunciado artístico visual. Apresenta três partes: a primeira, que determina o lugar ocupado pelo discurso estético nos trabalhos de Michel Pêcheux e de Michel Foucault; a segunda, que se concentra na análise de três pinturas europeias, a saber, As meninas, de Velásquez; Um bar (...) em Folies-Bergère, de Manet; e As ligações perigosas, de Magritte; e a terceira parte, que discute a intersecção entre visualidade e interdiscursividade a partir (a) das reflexões de M. The purpose of this text is to examine the nodal points of the interpretation of Bergson presented in “Bergson: Intuição e discurso filosófico”, by Franklin Leopoldo e Silva, in order to make explicit the originality of his circumscription of the problem of language in this philosophy that claims to be intuitive. We argue that the notions of limit and tension are mobilized by the author to demonstrate the inseparable relationship between the critique of discursivity and intuitive access to the absolute (...) that is duration. We will also try to show how this approach offers us a new look at the particular way in which Bergson links philosophy and the history of philosophy in his first work. (shrink)

O presente artigo se sustenta fundamentalmente em dois textos seminais de Franklin Leopoldo e Silva que representam uma contribuição essencial em meu caminho filosófico e especialmente na compreensão que desenvolvi e continuo desenvolvendo da filosofia bergsoniana. No meu modo de ver, tais textos iluminam, como poucos grandes textos, a originalidade, a importância e a potência de Bergson para o pensamento contemporâneo. Em diálogo com esses dois textos, associo, preponderantemente, textos do próprio Bergson e outros textos de Leopoldo e Silva, procurando (...) assinalar, a partir daí, o valor de suas filosofias em nossa formação ao integrarem pensamento, vida e história. Os Discursos à Nação Alemã de Fichte foram considerados durante muito tempo uma importante contribuição para o desenvolvimento do nacionalismo alemão e do pensamento nacionalista em geral Todavia, embora os Discursos continuem sendo lidos como um prenúncio das aspirações nacionalistas alemãs, grande parte de seu contendo substantivo é hoje ignorado. Neste artigo, o Autor examina um aspecto deveras negligenciado dos Discursos, a saber, o “sistema de educação nacional” neles propostos e que merecem séria consideração pelo modo como Fichte concebe e (...) articula o papel e função da intelligentsia em busca de salvação nacional. Argumenta-se, de modo especial, que é através da exaltação da educação que Fichte legitima sua proposta de governo por uma elite erudita, um tipo de despotismo esclareci do. Mostra-se ainda que o escopo dos privilégios concedidos aos “eruditos” na reforma educacional de Fichte solapa seu potencial radicalmente igualitarista, e que sua proposta termina por mostrar-se incoerente e inconsistente em seus próprios termos, na medida em que os propósitos explícitos de seu sistema e os resultados prometidos invalidariam completamente, se levados a cabo, a reivindicação dos esclarecidos de governa, se não a necessidade de tais governantes. Within feminist literature from the early 1970s to this day, assisted reproductive technologies have been largely known to divide, replace or eliminate biological motherhood. For example, while in the past biological motherhood was considered a continuous experience, in vitro fertilisation (IVF) and IVF using egg donation allowed a split between two biological mothers, one providing eggs (genetic mother) and the other one gestation (gestational mother). This split was considered irreparable: the genetic mother could not be also gestational, and vice versa. (...) On the contrary, this paper aims to show that assisted reproductive technologies may also have a constructive potential towards biological motherhood(s). To explain how it could be possible, two existing techniques are explored: the first is maternal spindle transfer, which allows a double genetic motherhood; the second is reciprocal effortless IVF, which supposedly enables a double gestational motherhood. While in the first part, these techniques are examined singularly, in the second part a feasible combination of them is speculated. The idea is that assisted reproductive technologies could ‘recombine’ genetic and gestational motherhood in two figures that include both, namely in two ‘complete’ biological mothers, both genetic and gestational. Empieza considerando al esencialismo frente al anti-esencialismo contemporáneo, en un segundo momento, la noción de existencia y, en seguida, las de identidad y cambio. Finalmente, se apela a la naturaleza de la predicación para mostrar que, contra el esencialista, la concepción del cambio de su contrincante sí logra resolver el problema de la unidad semántica de la proposición.

It is widely held that all lies are assertions: the traditional definition of lying entails that, in order to lie, speakers have to assert something they believe to be false. It is also widely held that assertion contrasts with presupposition and, in particular, that one cannot assert something by presupposing it. Together, these views imply that speakers cannot lie with presuppositions—a view that Andreas Stokke has recently explicitly defended. The aim of this paper is to argue that speakers can lie (...) with presuppositions, and to discuss some of the implications this outcome has for current research on lying, assertion and presupposition. Because rate of force development is an emerging outcome measure for the assessment of neuromuscular function in unfatigued conditions, and it represents a valid alternative/complement to the classical evaluation of pure maximal strength, this scoping review aimed to map the available evidence regarding RFD as an indicator of neuromuscular fatigue. Thus, following a general overview of the main studies published on this topic, we arbitrarily compared the amount of neuromuscular fatigue between the “gold standard” measure and peak, early and late (...) RFD. Seventy full-text articles were included in the review. The most-common fatiguing exercises were resistance exercises, endurance exercises/locomotor activities, isokinetic contractions, and simulated/real sport situations. The most widely tested tasks were knee extension and plantar flexion. The reason for evaluating RFD was lacking in 36% of the studies. On average, the amount of fatigue for MVF was comparable to late RFD but lower compared to both peak RFD and early RFD. Even if the rationale for evaluating RFD in the fatigued state was often lacking and the specificity between test task and fatiguing exercise characteristics was not always respected in the included studies, RFD seems to be a valid indicator of neuromuscular fatigue. Based on our arbitrary analyses, peak RFD and early phase RFD appear even to be more sensitive to quantify neuromuscular fatigue than MVF and late phase RFD. (shrink)

The distinction between lying and mere misleading is commonly tied to the distinction between saying and conversationally implicating. Many definitions of lying are based on the idea that liars say something they believe to be false, while misleaders put forward a believed-false conversational implicature. The aim of this paper is to motivate, spell out, and defend an alternative approach, on which lying and misleading differ in terms of commitment: liars, but not misleaders, commit themselves to something they believe to be (...) false. This approach entails that lying and misleading involve speech-acts of different force. While lying requires the committal speech-act of asserting, misleading involves the non-committal speech-act of suggesting. The approach leads to a broader definition of lying that can account for lies that are told while speaking non-literally or with the help of presuppositions, and it allows for a parallel definition of misleading, which so far is lacking in the debate. O presente trabalho tem como intuito estabelecer um diálogo entre as críticas traçadas por Gottlob Frege e Charles Sanders Peirce ao psicologismo. Trata-se de um estudo que visa contribuir para a compreensão de temas caros para a filosofia da linguagem, como a natureza do pensamento e a construção do significado. Para tanto, apresentaremos, de maneira geral, o conceito de psicologismo e alguns argumentos levantados a seu favor. Feito isso, elencaremos duas críticas ditas antipsicologistas: começaremos, na segunda seção, com o posicionamento (...) de Frege tomado no todo de sua obra no intuito de pensar seus reflexos no texto Sobre o sentido e a referência. Na terceira seção, abordaremos, na filosofia de Peirce, como o antipsicologismo está pressuposto desde seus escritos iniciais até o desenvolvimento de sua semiótica. (shrink)

Set of articles, fruits of research by anthropologists, focused on the health area. First work of its kind in the country, which deepens mental health issues, cosmological view of specific groups, relationships between body, mind and culture and healing issues seen from the perspective of various popular religions. The work contrasts with the efforts of health scholars to approach anthropological approaches, so that it becomes an instrument for understanding the health / disease phenomenon and its complex articulation processes.

Philo of Alexandria is a forerunner of both the union of philosophy and theology and the biblical hermeneutics of the text at various levels of deepening. Heir of a long tradition had his thinking rejected in Judaism after a break in the first century AD with Greek culture, but remained as a reference of Patristics and all Christian thinking, having a perennial influence. The hermeneutics in Philo is studied, its option for Platonism, its allegorical method and what our author sought (...) to contemplate through this method. The union of Greek, Jewish and Christian cultures is approached, seeking to analyze the complex reality that emerged from this encounter and the mark it left in the Bible, the works of Philo and the authors who were influenced by him. To understand the endogenous components of the event-related brain potential (ERP), we must use data about the components' antecedent conditions to form hypotheses about the information-processing function of the underlying brain activity. These hypotheses, in turn, generate testable predictions about the consequences of the component. We review the application of this approach to the analysis of the P300 component. The amplitude of the P300 is controlled multiplicatively by the subjective probability and the task relevance of the eliciting events, whereas its (...) latency depends on the duration of stimulus evaluation. These and other factors suggest that the P300 is a manifestation of activity occurring whenever one's model of the environment must be revised. Tests of three predictions based on this “context updating” model are reviewed. Verleger's critique is based on a misconstrual of the model as well as a partial and misleading reading of the relevant literature. (shrink)

We analyze recent criticisms of the use of hyperreal probabilities as expressed by Pruss, Easwaran, Parker, and Williamson. We show that the alleged arbitrariness of hyperreal fields can be avoided by working in the Kanovei–Shelah model or in saturated models. We argue that some of the objections to hyperreal probabilities arise from hidden biases that favor Archimedean models. We discuss the advantage of the hyperreals over transferless fields with infinitesimals. In Paper II we analyze two underdetermination theorems by Pruss and (...) show that they hinge upon parasitic external hyperreal-valued measures, whereas internal hyperfinite measures are not underdetermined. Dieses Buch bietet die erste systematische Interpretation von Husserls Ideen für eine reine Phänomenologie und phänomenologische Philosophie anhand der neuen kritischen Edition von Ideen II. Es ermöglicht eine phänomenologische Auslegung des allgemein-metaphysischen Problems, wie physische, mentale und soziale Tatsachen zusammenhängen. Das Buch diskutiert und interpretiert detailliert einige von Husserls zentralen Konzeptionen und zeigt die Konsequenzen seines Denkansatzes und seiner Theorieentwicklung. Natur und Gemeingeist sind Husserl zufolge die Grundbegriffe der naturalistischen und der personalistischen Einstellungen und dienen als Leitfaden der Unterscheidung zwischen (...) Natur- und Geisteswissenschaften. In der kritischen Auseinandersetzung mit diesem wissenschaftstheoretischen Dualismus führt Husserl den Habitus-Begriff methodisch ein, um das Verhältnis von Natur- und Sozialontologie aus der konkreten Erfahrung heraus phänomenologisch neu zu deuten, womit der spätere, anti-dualistische Weg der Lebensweltphänomenologie vorbereitet wird. In Husserls Studien zur Regionalontologie des Gemeingeistes rückt das konkrete Subjekt in den Vordergrund der Intentionalitätsanalyse, indem die sinntragenden Elemente der Inaktualitität auf Habitualisierungsprozesse und die Intersubjektivität auf Sozialisierungsstufen zurückgeführt werden. Dank der durch den Habitus-Begriff ermöglichten klaren Unterscheidung zwischen konstituierender Aktualität und konstitutiver Relevanz des inaktuellen Horizonts kann Husserls Philosophie des Geistes als individualistisch und holistisch zugleich gelten. Dieser ontologischen Position entspricht auch Husserls sozialepistemologische Ansicht, dass sich Wissenschaften erst im Rahmen idealisierter Sozialstrukturen entfalten können. Durch diese idealisierenden Operationen wird die Konstitution der Objektivität möglich, welche die Wissenschaften anstreben. Deren Rationalität ist deshalb in ihren konkreten und idealisierten Sozialitätsstufen und Habitualitäten zu befragen. (shrink)

The shooting bias hypothesis aims to explain the disproportionate number of minorities killed by police. We present the evidence mounting in support of the existence of shooting bias and then focus on two dissenting studies. We examine these studies in light of Biddle and Leuschner’s “inductive risk account of epistemically detrimental dissent” and conclude that, although they meet this account only partially, the studies are in fact epistemically and socially detrimental as they contribute to racism in society and to a (...) social atmosphere that is hostile to science as scholars working on issues of racism come under attack. We emphasize this final point via recourse to Kitcher’s “Millian argument against the freedom of research.”. (shrink)

In this paper we show how some reasoning, though fallacious, can appear to be attractive and useful for beings-like-us. Although they do not provide conclusive evidence to support or reject a certain claim the way scientific statements do, they tell us something interesting about how humans build up their arguments and reasons. First of all, we will consider and investigate three main types of fallacies: argumentum ad hominem, argumentum ad verecundiam, and argumentum ad populum. These three fallacies are traditionally considered (...) as examples of a broader category called ignoratio elenchi. Secondly, we show how people who commit these fallacies rely on information about other human beings in their reasoning. That is, they do not follow certain logical procedures that eventually lead them to correct conclusions. But they simply make use of others as social characters. For example, being an authority, being an expert, being part of a class, etc., become the substitutes for more direct evidence to support a certain claim or to make an argument more appealing.
